Legal Scrutiny Over GRA Appointment
Peter Karimi, Director General of Kenya’s Gambling Regulatory Authority, is under legal scrutiny regarding his qualifications. Two court cases are calling into question his February 2026 appointment, with allegations that Karimi does not meet the statutory requisites defined under Section 16(2)(c) of the 2025 Gambling Control Act. This law demands a minimum of ten years in senior management within the public or private sector, but Karimi’s tenure as CEO of Acumen Communications Limited from 2017 to 2022 only accounts for five years.
Conflict of Interest Allegations
Beyond the experience debate, Karimi faces assertions of conflict of interest. His former association with the mCHEZA betting platform introduces concerns due to a mandated five-year cooling-off period aimed at preventing overlaps between operators and regulators. Additionally, connections to Umsuka Capital Limited, reportedly closed by the Communications Authority of Kenya, further complicate his appointment.
Defense Arguments and COFEK Involvement
Karimi refutes these accusations, with his legal team, guided by Moureen Lagat, arguing for the transparency of his hiring process. The GRA Board, led by Joseph Kirui Limo, confirmed his qualification legitimacy. Karimi has suggested dismissing the High Court petition or transferring it, contending it pertains to recruitment practices rather than constitutional rights. Meanwhile, the Consumers Federation of Kenya (COFEK) plans to engage in the case, worried about leadership stability at GRA affecting over 15 million Kenyan participants in gaming.
Broader Impact on Regulatory Framework
This legal battle emerges as the GRA navigates the transformation from the former Betting Control and Licensing Board (BCLB), amid crucial compliance checks for significant operators. With a licensing deadline for 99 operators approaching, COFEK aims to ensure uninterrupted regulatory supervision despite ongoing litigation. The outcomes of these cases remain undetermined as proceedings continue.
