Online entities must begin with a KES 5 million application fee and a KES 50 million license fee, along with an ongoing annual fee of KES 5 million for both casinos and bookmakers. Additionally, holding substantial liquid capital is essential, with online venues needing KES 100 million and the National Lottery requiring KES 2 billion.
Overhaul of Advertising Practices
New advertising regulations alter promotional strategies by imposing a 6% marketing levy on the advertising budget, plus a KES 50,000 fee per campaign. Using celebrities and public figures for endorsements is prohibited, and there are significant restrictions on media placements.
Regulations for Foreign Operators
Foreign operators face a KES 10 million application fee, a KES 100 million license fee, and must secure a KES 200 million financial bond. A 30% local equity stake is generally necessary, unless all revenue is externally derived, with preventive measures required to block local access.
Conduct and Responsible Gaming Standards
Operators must implement responsible gaming tools and comply with proximity limitations, barring operations near schools or religious sites. New mandates also protect player privacy and govern payout timelines for winnings.
Gambling Appeals Process
A Gambling Appeals Tribunal has been established to handle grievances against GRA decisions. Operators must use internal GRA procedures before appealing to the Tribunal, ensuring an equitable resolution framework.
