Overseas gambling companies targeting Kenyan consumers are now subject to potential fines of up to KSh50 million. The Gambling Regulatory Authority of Kenya (GRA) introduced the Gambling Control (Foreign-based Operators) Regulations, 2026, necessitating the use of IP geo-blocking and identity verification to prevent unauthorized access by Kenyan residents. This initiative aims to curb revenue losses and support local licensed operators adhering to the country’s tax requirements, which include a 15% levy on betting income and a 20% tax on winnings.

Ensuring Compliance

To confirm adherence, GRA will perform quarterly audits of digital boundaries and mandate remote access to operators’ central servers in real-time. These stringent requirements, along with the financial obligations such as maintaining a minimum capital of KSh100 million and securing a KSh200 million bond or guarantee, ensure that only financially robust operators can obtain a license in Kenya.

Betting companies are obliged to suspend accounts if they observe signs of financial distress or compulsive behaviors among customers.
